Client Charter

1. Safety and Security of Operations
At Bank Islam, we are strongly committed to protect the security and confidentiality of your personal or private information. For this purpose we have placed strong security measures to prevent unauthorized access which could result in the alteration, destruction, theft of data or compromise the confidentiality of our customer’s data. Our mobile banking utilizes commercially proven security hardware and software products in our system, network and application infrastructure. These security products include routers, firewalls and a secure operating system. All of our connections must pass through at least one router and one firewall to gain connectivity to the server. The firewall checks for the appropriate source address, and is able to restrict the traffic to the appropriate server.

Please note that you play a part in the system security as well. Although we exercise every effort to provide a variety of safety, secure and reliable system, we do not have control over your mobile phone or other instruments used by you to access our services and further transmission over the phone cannot be guaranteed, warranted or represented to be absolutely secure. You SHOULD NOT share your TAP PIN or TAP PASSWORD with any other person and you should never display your account information in an area, where it is visible to others.

2. Privacy Policy
At Bank Islam, we respect every individual’s right to privacy. Our relationship with you is our most valuable asset and is the very basis of our name and reputation. We understand the importance of you, as the Bank’s customer and user, place on the privacy and security of information that personally identifies you or your account information. We refer to and treat this information as “personal information”. We extend the following privacy policy to you.  3. Reliable and Quality Services
At Bank Islam, we are committed at all times towards providing reliable and quality services to our customers. We will ensure that all personnel and staff involved in providing these services have the necessary expertise and skills. We shall only offer services and products that are tailored to your needs and success. We shall achieve this by fully understanding your goals and objectives while ensuring service standards that are consistent and efficient.
4. Transparency Of Products and Services
We will use our reasonable endeavours to ensure that our descriptions and details of products and services offered by us are clear and true. Security Statement

This Security Statement applies to the Bank Islam Mobile Banking Services owned and operated by Bank Islam Malaysia Berhad (hereinafter referred to as “Bank Islam”).
Bank Islam is committed to protect the privacy of your personal and financial information. For the purposes herein, all words and expressions shall have the same meaning as in the Terms and Conditions for Mobile Banking Services, except where otherwise expressly stated.Bank Islam aims to maintain strict procedures and standards, and take all reasonable care to prevent unauthorized access to your personal information, and to protect the security of your personal information during transmission. Bank Islam constantly monitors developments in security and encryption technology and will review and update its processes in line with industry standards. Customer’s Obligations

As a customer, you play an important role in ensuring the security of your mobile banking transactions. To secure the information transmitted between your personal mobile phone and Bank Islam Mobile Banking Services, you will need mPOD.Bank Islam aims to maintain strict procedures and standards, and take all reasonable care to prevent unauthorized access to your personal information, and to protect the security of your personal information during transmission. Bank Islam constantly monitors developments in security and encryption technology and will review and update its processes in line with industry standards.Bank Islam has taken several security initiatives such as deploying technological hardware and software, policies and procedures, and addressing operational security issues.Bank Islam Mobile Service is secured with a digital certificate to enable safe communications with our customers. Such feature ensures message privacy and message integrityBesides that, its goal to protect the privacy and security of your information Bank Islam, has implemented the following security features:

1. TAP PIN and TAP Password Verification

Personal information supplied by you through our Mobile Banking Services shall be used in providing Bank Islam’s services. Bank Islam may also use your personal information to market Bank Islam’s products and services to you are based on your interests and to mainly assist Bank Islam in customizing and delivering its services and products that may be of interest to you.
Bank Islam will refrain from using or disclosing all or any of your personal information including information collected using cookies, other than for the purpose made known to you, a purpose you would reasonably expect, a purpose required, authorized or permitted by or under law, or a purpose otherwise authorized by you.You agree that Bank Islam shall not disclose your personal information unless the following circumstances apply:
  1. Authentication

    Your TAP PIN and TAP Password will be used to authenticate you for Bank Islam Mobile Banking Services during the enrolment process.

    Your TAP PIN and TAP Password will be used to authenticate you for Bank Islam Mobile Banking Service during subsequent logins. To ensure the integrity of your TAP PIN and TAP Password, Bank Islam advises you to periodically change your Password and under no circumstances should you reveal your password to anyone. You should not disclose your password to any Bank Islam’s personnel even if requested to do so. When selecting a password, do not associate your selected password with anything personal such as names, birth dates, phone numbers or other familiar words in order to ensure confidentiality of your password.

     

  2. Account Locking

    Attempts to impersonate valid users are locked by Bank Islam’s system after three (3) incorrect sign-on attempts

2. Encryption of Data

An advanced (U) SIM card technology is composed of a patented material tailored to serve as an intermediate “security token” between an existing SIM card and the mobile’s SIM card connector. It contains a microchip that provides encryption and secure data storage which meets international security standards and certified by CCEAL5+ and EMV.

All transaction requests initiated using the mPOD will be encrypted using the embedded hardware encryption engine and delivered using SMS as the communication channel. The message will be encrypted using “Ever Changing Session Keys” which are generated using the industry standard of Open Authentication (OATH) algorithm. In addition to encryption, each such SMS also contains a security code representing the integrity of the SMS that is verifiable at the engine embedded in the mPOD.Encryption algorithm – mPOD uses the Triple DES (3DES) encryption algorithm with a key length of 168 bits. Each mPOD client would have its own secret key that is used to encrypt and decrypt the message thereby increasing the security and protecting the identity of each mPOD client.
3. Session Key Generation
Our mPOD uses the OATH One Time Session PIN algorithm with a key length of 168 bits. This algorithm generates unique, random session keys that will be used by 3DES encryption algorithm to protect the data.
Besides that, for our Mobile Payment System, it uses TrustFieldTM Cryptographic Key Server (CKS) to protect, manage and authenticate users before the end user is allowed access to the Bank’s network. The CKS is a cryptographic solution that stores, guards and processes the secret key of each mPOD client.
4. Firewalls & Intrusion Detection Systems
Firewalls act as filters that prevent information from getting in or out of a protected network. Bank Islam also has an intrusion detection system to automatically disable attacks from hackers. The intrusion detection system alerts Bank Islam’s security personnel about possible attacks-in-progress and Bank Islam keeps audit logs to provide a trail of information.
5. Anti Virus Application
With the outbreak of viruses over the Internet, it is critical for Bank Islam to have anti-virus applications. Bank Islam has implemented industry standard anti-virus applications to ensure its systems are safe from viruses. For safe and secure mobile banking sessions, you should ensure that you have implemented anti-virus software on your personal mobile phone for added protection.
6. Enquiries and Complaints
Always remember to check the successful message after you have completed your mobile banking session. If you suspect any unusual account activity, is taking place, please contact Bank Islam immediately using the contact information provided above.

Privacy Policy

  1. For Bank Islam, the only personal information we will collect is the personal information provided to us by you upon registration. You can, at any time during the provision of the service, view the personal information that we are holding about you by submitting a request to our branches to view your personal details we have on our records.
  2. Any personal information you provide to us will only be used for the purposes for which you have provided it, and will only be used by us, other members of the Bank Islam group of companies or third parties operating and delivering the Mobile Alert service on our behalf, or otherwise assisting us with this service. Your personal information will be transferred to and held on our web server in Malaysia. It will only be used and held by us, or on our behalf. After termination or expiry of the service, for whatever reason, we will retain non-identifying records of the service usage, so that we can ascertain how much usage was made of it, and in which countries.
  3. Except as explained in 2 above, we will not pass any of your personal information to any third party without your consent. However, we may from time to time make non-identifying statistical information available to third parties or at the request of authorities.
  4. We do not use cookies for collecting user information from the phone and we will not collect any information about you except that required for system administration of the mobile server and otherwise as described above.
  5. If we decide to change our Privacy Policy, we will post the changes here. However, if we make material changes to the way we use your personal information we will seek your consent to do so unless we are required under any relevant law to release such information.

 

Rules Governing The Operation of Mobile Banking Services


1. Bank Islam Mobile Banking Services Terms and Conditions
  • The following Terms and Conditions shall apply to the customer’s access and use of Bank Islam Mobile Banking and the services provided herein by Bank Islam Malaysia Berhad (Bank Islam). By accessing Bank Islam Mobile Banking and/or using the services, the customer hereby agrees to be bound by these terms and conditions without limitation or qualification.

2. Ijarah Contract

  • I/We hereby agree to use Bank Islam Mobile Banking Services by using Ijarah contract and I/we hereby agree to be charged on the services given by the Bank.

3. General

  • The information, material, products and services described or offered in the Mobile Banking Services are not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject Bank Islam to any restriction within such jurisdiction or country.

  • The customer is advised to seek independent legal, financial or other advice as the customer deems necessary at all times before making any decision based on any such information, material, content or advice.

  • The information, material, contents and services provided in the Mobile Banking Services may change from time to time at Bank Islam’s sole discretion.

  • The Terms and Conditions herein and all supplements, amendments and variations shall collectively constitute an agreement between the customer and Bank Islam and shall apply to the Mobile Banking Services.

  • The Terms and Conditions operate in conjunction with the respective account terms (as hereinafter defined) which the customer represents that he has read, understood and agreed to be bound without qualification or limitation by his usage of the Mobile Banking Services.

4. Disclaimers

  • The information and materials in the Mobile Banking Services, including but not limited to services, products, information, data, text, graphics, or other items are provided by Bank Islam on ‘as available’ basis. All such materials and information (including text, graphics or other items) are subject to change without notice at Bank Islam’s sole discretion.

  • References to information and material contained in the Mobile Banking Services shall include any information and material as may be provided by the authorized third parties. The customer is advised to visit, telephone, e-mail, fax or write to such parties for more information or to confirm the information contained.

  • Bank Islam does not make any express or implied warranties, representations or endorsements including but not limited to any warranties of title, non-infringement, merchantability, usefulness, operation, completeness, current, accuracy, satisfactory quality, reliability, fitness for a particular purpose in respect of the Mobile Banking Services, the material, information and/or functions therein and expressly disclaims liability for errors and omissions in such materials, information and/or functions.

  • In implication and not in derogation of the above and/or the terms and conditions of the applicable agreements governing all the products and services of Bank Islam, reasonable measures has been taken by Bank Islam to ensure the accuracy and validity of all information relating to transactions and products of Bank Islam.

  • Bank Islam shall not be responsible or liable for any loss caused or damage incurred or suffered by the customer or any other person as a consequence of using the Mobile Banking Services.

  • Further, Bank Islam does not warrant or represent that access to the whole or parts of the Mobile Banking Services, the materials, information and/or functions contained therein will be provided uninterrupted or free from errors or that any identified defect will be corrected, or that there will be no delays, failures, errors or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your mobile phone system.

5. Trade Mark

  • All trade marks, service marks, and logos displayed in the Mobile Banking Services are the property of Bank Islam and/or their respective third party.

6. Exclusion of Liability

  • Bank Islam shall not be held liable for any loss or damages whatsoever arising whether in contract, tort, negligence, strict liability or any other basis, including but not limited to, direct or indirect, special, incidental, consequential or punitive damages, or loss of profits or loss of savings arising in connection with the customer’s access or use or the inability to access of use the mobile banking services, any technical failure of any kind, the interruption, error, omission, delay in operation or otherwise, whether or not Bank Islam has been advised of the possibility of such damages or loss. This exclusion clause shall take effect to the fullest extent permitted by law.

7. Indemnity

  • The customer shall indemnify and keep indemnified Bank Islam from all liabilities, claims, losses and expenses, including any legal fees that may be incurred by Bank Islam in connection with or arising from:

    • Customer’s use or misuse of the services provided herein; or

    • Customer’s breach of these Terms and Conditions howsoever occasioned.

8. Termination

  • Bank Islam reserves the right to terminate and/or suspend customer’s access to the Mobile Banking Services and/or customer’s use of the Mobile Banking Services at any time, for any reason whatsoever. In particular, and without limitation, Bank Islam may terminate and/or suspend customer’s access should customer violate any of these Terms and Conditions, or violate the rights of the Bank Islam, of any other user, or of any third party.

  • The customer acknowledges that termination will not affect the customer’s liability or obligations in respect of instruction already processed and/or effected by Bank Islam on the customer’s behalf.

9. Exclusion

  • The failure of Bank Islam to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

  • If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to any applicable law, then the invalid and unenforceable provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remainder of the other provisions of the terms and conditions shall continue in full force and effect.

10. Change of Terms and Conditions

  • Bank Islam reserves the right to vary, amend or supplement any of the Terms and Conditions by way of notice in such manner as deemed suitable by Bank Islam from time to time, subject to the approval of relevant authorities. The customer should be able to view the revised Terms and Conditions upon access to the Bank Islam Mobile Banking Services User Guide and at Bank Islam Internet Banking and use of the services thereafter shall constitute the customer’s acceptance to the variations, amendments or supplements.

11. Law and Jurisdiction

  • These Terms and Conditions are governed by and shall be construed in accordance with laws of Malaysia. By using the services provided herein by Bank Islam, the customer hereby consents to submit to the exclusive jurisdiction of the Courts of Malaysia in all disputes arising out of relating to the use of the Mobile Banking Services.

  • Bank Islam makes no representation that the materials, information, functions and/or services provided on the Mobile Banking Services are appropriate or available for use in jurisdiction other than Malaysia.

  • The maximum amount of a transaction and the purpose for which it is charged may be varied/determined from time to time at the absolute discretion of Bank Islam pursuant to the laws and regulations of the country in which the transaction is effected or requested (or based on such directions by Bank Negara Malaysia).

12. Definition in these Terms and Conditions :

  • ‘Account’ means an account in the name of the customer the operations of which shall be made by the customer through the use of the mPOD while doing mobile banking transaction.

  • ‘The Bank’ or ‘Bank Islam’ means Bank Islam Malaysia Berhad.

  • ‘Bank Islam mPOD’ means the Chip issued to the customer of the Bank.

  • ‘Customer’ means any person to whom the Bank has issued the mPOD.

  • ‘PIN’ means Personal Identification Number chosen by the customer upon receiving the mPOD which maybe changed by the customer subsequently if there is a necessity to change.

13. Access Information

  • Access information is the
    information required from the customer before entering certain parts of the
    service for which the customer has registered, which may be a username,
    password, customer’s mobile phone number or any other or similar recognition
    device.

14. Account

  • Any customer who wishes to apply to the Bank Islam Mobile Banking Services herein will be required to open an account with Bank Islam if he/she does not already have one with the Bank. The Bank shall then issue Bank Islam mPOD to the customer.
  • The customer is required to maintain a sufficient balance of his account at all times.

  • The customer may subject to the availability of funds in the account transfer up to the maximum of RM30,000.00 per transaction per day to a third party account. Transfer of funds to customer’s own account maybe made by the customer without any limit.

  • The Bank has the absolute right to amend the withdrawal limit or the transaction limit, at any time and written notice will be given to the customer in any form or methods prescribed by the Bank.

  • In the event of doing transaction for bills payment service and transfer of funds to third party, the Bank shall not be liable for any account number that is wrongly keyed in by the customer for the intended transaction.

  • The Bank’s record of any transaction processed by the use of the mPOD shall be conclusive and binding for all purposes.

  • The mPOD shall not be used after its cancellation or upon the closure of the account by the Bank or by the customer.

 

15. PIN

  • The customer shall be required to enter 4 preferred digits to be his/her PIN to enable him/her to access the mobile banking services herein.

  • The customer shall at no time and under no circumstances reveal or cause to reveal the PIN to any third party including the Bank’s personnel.

  • The customer shall immediately notify the Bank in the event that the PIN is exposed or suspected exposed to any third party and upon which event, the Chip shall be surrendered to the Bank for the purpose of issuing a replacement Chip subject however to the provision of Clause 4.6 hereof. The Bank reserves the right to levy a charge for the issuance or a replacement Chip.

16. Chip Service Fee and Other Charges

  • The service fee for the mPOD is RM8.48 annually. This will be in addition to other charges imposed on the customer based on the types of transactions effected by customer via the Mobile Banking Services herein. The Bank may, at its sole discretion and subject to the approval of related authorities, vary the charges from time to time as deemed necessary.

  • The customer must ensure that his/her account balance is sufficient for the Bank to automatically debit the service fee from the account.

  • The Bank will impose the service fee for the Mobile Banking Services on the day the application is made and its subsequent anniversary as long as the mPOD remains valid for use of the Bank’s services.

  • Subject to the Clause 16.3 above, the customer has to pay for a replacement mPOD issued in place of a mPOD reported lost, damaged, misplaced or for any other reason whatsoever. The Bank may in its absolute discretion refuse to issue a replacement mPOD without assigning any reason thereto. A replacement Chip shall be governed by the Terms and Conditions herein agreed.

17. Customer’s Responsibilities

  • The customer shall be fully responsible for all transactions made through the use or intended use of the mPOD and shall not hold the Bank, its servants or agents liable for any loss or damage suffered by the customer arising out of any technical, electrical or electronic failure or defect of the mPOD or for any reason whatsoever.

  • The Bank shall not be liable for any withdrawal made through the customer’s mPOD from the account. The customer shall immediately notify the Bank in writing in the event of loss, theft or destruction of the mPOD. The Bank shall not be liable for any loss or theft of mPOD together with the PIN.

  • The property of the mPOD is belonged to the Bank. The customer shall ensure that the micro processor, magnetic stripe and/or data in the mPOD are not in any way altered or tampered with by any means whatsoever and without affecting the customer’s ownership of the mPOD, the customer hereby agrees that the Bank shall have the right to retain possession of the mPOD upon request by the Bank to surrender the same for the purpose of verification, rectification or validation of the data stored therein or otherwise.

  • The mPOD is issued solely to / for the use of the customer only and is not transferable. The customer shall not use the mPOD as a pledge or guarantee in securing credit facilities.

  • The Bank will only affix the mPOD to the customer’s SIM upon getting the consent from the customer. The Bank shall not be liable for any damage caused to the customer’s SIM card in the course of affixing the mPOD required for the activation of the Mobile Banking Services herein.

  • The bank reserves the right to vary the hours of operation of mobile banking services without prior notice to the customer.

  • An application for the Mobile Banking Services herein maybe made by any person who is 18 years old and above.

  • Customer must check and sign an acknowledgement slip upon receiving the mPOD from the Bank’s officer.

18. Others

  • Unless expressly stated to the contrary herein, all other Terms and Conditions governing the operations of an account with the Bank shall remain and be binding with full force and effect on the account and/or the customer.

  • Notwithstanding anything to the contrary herein, the Bank shall have the right to close the account without assigning any reasons thereto.

  • The customer expressly agrees that the use of the mPOD shall be at the customer’s sole risk. The customer shall assume any and all risks incidental to or arriving out of the use of the mPOD.

  • The Bank shall at anytime by notice to the customer be entitled to amend, vary or add to any of these Terms and Conditions. The customer undertakes to be bound by any such amendments, variations or additions. Publications of any such notice by such means as the bank may deem fit shall constitute effective notice to the customer.

  • The headings in these Terms and Conditions are inserted for convenience only and shall be ignored when construing the provisions of the same.

19. Goods And Services Tax (GST)

  • In this Clause:-

    • “GST Act” refers to the Goods and Services Tax Act 2014 and shall include any by-laws, instruments,
      orders, rules and regulations made thereunder.

    • Any words and expressions which have a defined meaning in the GST Act shall have the same meaning as
      the GST Act.

  • This Clause shall only apply upon the implementation date of the GST Act in Malaysia. It is acknowledged and agreed that this Clause may be subsequently revised by the Bank to be in compliance with the prevailing GST Act at the material time.

  • Unless otherwise expressly specified in this document/Agreement any sum payable to the Bank, being the consideration under or in connection with this document/Agreement, is exclusive of GST (“GST –exclusive consideration”) .

  • The consideration for such taxable supply shall be increased by an amount calculated as follows:-

    A is the consideration payable for the taxable supply : and
    R is the applicable rate of GST prevailing at the time of supply
    (hereinafter referred to as the “GST Amount”)

  • If an adjustment arises in connection with any taxable supply made or deemed to be made under or in connection with this document/Agreement ,the GST Amount payable for such taxable supply will be recalculated to reflect the adjustment event and the payment for the difference thereof will be made to the Bank or by the Bank, as the case may
    be.
